Fines for establishments for noise pollution

THE CALVIÀ TOWN HALL BEGINS PROCEEDINGS TO FINE WITH A MINIMUM CLOSURE OF ONE MONTH AND ONE DAY OF MUSICAL ACTIVITY 13 ESTABLISHMENTS OF THE PUNTA BALLENA AREA AND ONE OF RAMON DE MONTCADA FOR A SERIOUS INFRINGEMENT OF THE LAW AGAINST ACOUSTIC POLLUTION OF THE BALEARIC ISLANDS

These establishments have commited infractions by keeping their doors open from midnight

The Calvià Town Hall has initiated disciplinary proceedings against 13 establishments in Punta Ballena Street and one in Ramon de Montcada, for a serious infraction of Law 1/2007, of 16 March, against noise pollution in the Balearic Islands, for repeatedly maintaining the doors open of these premises commiting continuous infringement, which has led to the initiation of different proceedings. The Calvià Local Police has verified that these premises kept the doors open, from midnight, some of them with elements (stools, chairs, wedges, etc.) that prevented their closure. The Municipal bylaw for the environment protection against noise and vibration pollution establishes in Article 44.3 that "[...]. At night, the activity will take place with doors, windows, holes and any type of openings closed. "

Due to the seriousness of this breach, these establishments will face a penalty of between 601 and 12,000 euros and the suspension of musical activity between a month and a day to a year, since, in some cases, they have commited 3 or more infractions in a period of 15 days for having the doors open, and, in other cases, have commited an infraction for fastening doors with some sort of element.

These records and the initiation of proceedings, respond to the campaign of monitoring and control of noise pollution by open doors scheduled by the Technical Committee of activities of the Calvià Town Hall, which has received numerous complaints from neighbours and shopkeepers of the area.

With the initiation of proceedings, the mandatory procedure is opened in which, before reaching the final sanctioning resolution, the establishments can submit claims.
