Justice does not allow Oratori's restaurant

JUSTICE SIDES WITH CALVIÀ TOWN HALL FOR NOT ALLOWING THE CONSTRUCTION OF A RESTAURANT NEXT TO PORTALS' ORATORY

The argument is based on the fact that it would have a high environmental impact and that it is not a building land plot

Nuestra Señora de Portals parish church will not be able to build a restaurant near the Oratory since the Contentious Administrative Court No. 2 of Palma has dismissed the appeal that it had filed against the Calvià consistory that denied the initiative. In addition, the Parish church must pay 1.000 € for defence costs. However, the judicial decision may be appealed.

The argument is based on the high environmental impact that the restaurant next to the Oratory would have, with visual impact from both land and sea. The ruling highlights the awareness of public authorities and citizens in preserving the aesthetics of the environment in such a fragile area, since the existing vegetation is low and that 410 m2 would be altered to build a new building. It should also be noted the strong neighbourhood opposition to the initiative of another restaurant in Portals Nous, in a place where the harmony of the Oratory area landscape would be broken, a temple classified as a Cultural Interest Site.

The other argument provided by Calvià Town Hall is that it is not a building land plot, since it does not meet the required urbanisation conditions, such as the necessary electricity supply, poor accessibility conditions and lack of parking areas.
