Information following the resolution of the Central Administrative Tribunal of Contractual Appeals
CALVIÀ TOWN HALL IS STUDYING THE BEST SOLUTION TO ENSURE THE TAX MANAGEMENT AND COLLECTION SERVICE
The Central Administrative Tribunal of Contractual Appeals annuls the service's tender procedure considering that two of the awarding criterion approved in 2014 are null and void
The Calvià Town Hall is considering applying the best formula to ensure the tax management and collection service, after the Central Administrative Tribunal of Contractual Appeals issued a resolution which annuls the tender procedure of said service. In said resolution, the Tribunal declares null and void two of the awarding criterion included in the administrative bid specifications approved by the Local Administration Board on 24th November 2014.
At present, two alternatives are essentially being considered: the direct management of the service by the Town Hall, or entrust the service to the Autonomous Community.
While a final decision is taken, the service is guaranteed until 30th April by the previous awardee, given that an extension was formalized during the appeal's resolution period.
The previous contract, dated 2nd November 2009, ended on 31st December 2015. For the new contract, on 24th November 2014 they proceeded to begin the new contracting of the service, by publishing the announcement in the BOIB of 23rd December 2014.
The Contract Awarding Committee met on 10th February 2015 for the opening of the envelopes number 3 (envelopes that contain the descriptive memorandum of the service's organization and the improvements offered by the bidders).
The Contract Awarding Committee met on 4th November 2015 for the opening of the envelopes number 2 (economic offer), and report on the assessments made of the envelope number 3. On 4th December 2015, the Local Administration Board gives the green-light to the awarding of the contract, and on 23rd December (deadline), one of the bidders presents an appeal. On 14th January 2016, the Central Administrative Tribunal of Contractual Appeals suspended as a precautionary measure, the recruitment procedure, and on 12th February 2016 it issued an order of annulment of the recruitment process.
In view of the resolution, the Calvià Town Hall has several options to give answer to this situation, which will be resolved in the coming days.
The Town Hall reiterates that at no time the tax collection service has been suspended, nor will be suspended from the moment there is a resolution on the appeal.
