Communiqué of Calvià Town Hall related to the judgement of the Consell Consultiu regarding the revision of the opening licence and operation of the discotheque BCM
Calvià Town Hall informs that it maintains the precautionary closure of the discotheque, since the judgement of the Consell Consultiu does not affect this procedure, but to the file of the revision of the opening licence and operation of BCM. The Consell Consultiu is silent on said closure and this is expressly stated in its Judgement.
The judgement of the Consell Consultiu refers to the file of the revision of the opening licence and operation of the discotheque BCM that the Town Hall initiated ex officio and in the scope of the proceedings followed in the Magistrate's Court No 12, on detecting a series of irregularities centered on cooling towers which affected the original opening licence and operation of the discotheque BCM, on which no conclusion had yet been reached. Although not sharing its conclusions, the Town Hall complies with said judgement, given its mandatory and binding nature.
The Judgement concludes that a revision of the original activity licence is not necessary, given circumstances such as the elapsed time, and, in short, it is considered that there are no grounds for its absolute nullity. However, it does say that irregularities concerning the towers must be remedied.
As for the closure, it was decreed given a concurrence of irregularities in the works project started in 2015. These irregularities consist of a relevant omission of data, in reference - in addition to the cooling towers -, to certain facilities which by lack of a licence are illegal, and to facilities that the Town Hall considers that endangers the safety of people, since they mainly affect the evacuation routes of the discotheque.
Given that these security deficiencies- on which the Consultiu is silent – have not been remedied, the Calvià Town Hall maintains the precautionary closure pending their amendment and the amendment of the rest of irregularities by BCM.
In this sense, on the part of this Consistory, repeatedly and through different means has urged the property to remedy the deficiencies that have motivated the closure and that could have allowed its reopening.
