INFORMATIVE NOTE FROM THE LOCAL POLICE OF CALVIÀ
50 NOISE COMPLAINTS IN MAGALUF AND SANTA PONÇA
With the summer season the number of fines for causing discomfort and make it difficult for residents to rest has increased
In the last two weeks, the Local Police of Calvià has reported different premises on 30 occasions for having the doors open after midnight. In this same period of time, 20 complaints have been filed for maintaining the activity on the terraces after the permitted time (usually until 3:00 a.m.). The agents have filed most of the complaints in the Magaluf and Santa Ponça areas, in compliance with the Municipal Ordinances and in what directly affects residents' rest.
Having doors open after midnight is considered a serious infraction, contained in Law 1/2007, of 16th March, against the noise pollution of the Balearic Islands, and may involve a fineof up to 12,000 €. It is also considered a serious infraction to keep the activity on terraces outside of the established schedule, since it does not comply with the Regulating Ordinance of the Closing Times of public establishments and shows and may imply a fine of up to 10,000 €.
The difficulty to combine leisure activity in the areas of Magaluf (Punta Ballena street) and Santa Ponça (Ramon de Montcada street) with the rest of the neighbors should be taken into account. In fact, in these areas, the Town Hall has informed through a graphic campaign on fines for uncivic behaviour, including shouting that it can be sanctioned with 400 €. In addition, neighborhood associations have shown their discomfort with noise during the summer season on several occasions.
According to the Law 37/2003 of Noise in the night period, which is when these infractions take place by some terraces and night bars, the decibel level must never exceed 35.
