INFORMATIVE NOTE FROM THE LOCAL POLICE OF CALVIÀ

A BAR IN PALMANOVA AGAIN BREACHES COVID-19 RULES

It is an establishment where safety distances and capacity were not respected, and that this summer was already proposed for fine

The Local Police of Calvià has reported this weekend in a famous place on Son Maties beach, in Palmanova, where COVID-19 regulations were not followed. The police officers, alerted by two phone calls from two different neighbours in the area, went to the club on Saturday at 6.10 p.m. where they said there was a party. The club had scheduled several DJ sessions, live music and raffles for this weekend. Upon the arrival of the Police, there were 47 clients and four bar workers in the establishment. The local police of Calvià found that the distance of 1.5 m between the tables was not respected, the information poster on current regulations was not displayed, nor was the allowed capacity. Given these circumstances, the police officers drafted a sanctioning document and took photographs.

It should be noted that before the police action, the head of the club placed the tables in a correct way. However, it is an establishment that was already fined this summer in a joint action by the Calvià Local Police, the Civil Guard and inspectors of the Balearic Government. The reasons detected were that safety distances were not maintained and that the clients did not wear a protective mask. All this information will be transferred to the Balearic government, competent in the matter, which will be able to evaluate if it is a serious infraction. According to Decree Law 11/2020 of 10th July, which establishes a specific sanctioning regime to deal with non-compliance with the provisions issued to alleviate the effects of the crisis caused by COVID-19, this type of non-compliance of the norm corresponds to them a fine between 3.001 and 60.000 euros.

The amount of the possible fine to the Palmanova club will have to be graduated taking into account criteria such as recidivism, the number of people affected, the intentionality, and the benefit obtained as a result of the offence.

On the other hand, also on Saturday, the Calvià Local Police switchboard received a notice at 9.30 p.m. that a restaurant on the beach promenade in Palmanova did not comply with the health measures established by COVID-19, so the patrol went to the premises, drafted a report and proposed the establishment for sanction. In a similar line, the week before at 8.45 p.m. the police officers received a call informing them of a bar on the Andratx road that was not complying with the Plan of exceptional prevention, containment and coordination measures to deal with the crisis caused by COVID-19. The Local Police of Calvià drew up a report because the premises did not have the sign indicating the maximum capacity allowed or the hours of the premises. Failure to comply with the regulations by the restaurant and bar would correspond to a minor offence, so the penalty would be a fine of between 100 and 3.000 euros each.
