Public employees have the right to collective bargaining, representation, and institutional participation in determining their working conditions (Royal Legislative Decree 5/2015, of October 30, approving the consolidated text of the Basic Statute of Public Employees).

The specific bodies of representation for civil servants are the Staff Delegates and Staff Boards.

The Staff Boards will be established in electoral units with a minimum census of 50 civil servants. Each Staff Board is made up of a number of representatives, depending on the number of civil servants in the corresponding electoral unit, in accordance with the provisions of the Workers' Statute.

The Staff Boards and, where applicable, the Staff Delegates, will have the following functions in their respective areas:

  • Receive information on personnel policy, as well as data related to the evolution of wages, probable evolution of employment in the corresponding area, and performance improvement programs.
  • Issue reports, at the request of the corresponding Public Administration, on the total or partial transfer of facilities and the implementation or review of its organizational systems and working methods.
  • Be informed of all sanctions imposed for very serious offenses.
  • Be aware of and consulted on the establishment of working hours and work schedules, as well as the vacation and leave policies.
  • Ensure compliance with current regulations on working conditions, occupational risk prevention, Social Security, and employment, and take appropriate legal action before the competent bodies when necessary.
  • Collaborate with the corresponding Administration to achieve the establishment of measures that ensure the maintenance and increase of productivity.

Members of the Staff Boards and, where applicable, the Staff Delegates, as legal representatives of civil servants, will have the following guarantees and rights in the exercise of their representative function:

  • Access and free movement through the premises of their electoral unit, without hindering the normal functioning of the corresponding administrative units, within regular working hours and except in areas restricted under current legislation.
  • Free distribution of publications related to professional and union matters.
  • The right to a hearing in disciplinary proceedings that may affect their members during their term and during the year immediately following, without prejudice to the hearing of the individual concerned, as regulated in the disciplinary procedure.
  • A monthly credit of hours within the working day, remunerated as effective work hours.
  • Not being transferred or sanctioned for reasons related to the exercise of their representative mandate, either during its term or in the year following its expiration, except for termination due to revocation or resignation.

The term of office for members of the Staff Boards and, where applicable, the Staff Delegates, will be four years, and they may be re-elected. The term will be automatically extended if, upon its expiration, new elections have not been held, without the extended-term representatives being counted for the purposes of determining the representative capacity of the Unions.
