22 COMPLAINTS FILED FOR BREACHING THE MUNICIPAL ORDINANCE ON DYNAMIC ADVERTISING


Police control focuses on PRs, their location and schedules

 

The Local Police of Calvià is monitoring that the dynamic advertising carried out manually or orally in the municipality is carried out according to the municipal ordinance and the decree approved on 8th May. In the last week, 15 public relations of ten different establishments have been sanctioned for carrying out oral publicity without licence. In addition, seven complaints have been filed for leaving publicity brochures in the street. The sanctions in both cases are considered serious and range from 601 to 6,000 €.


All sanction proceedings have been communicated to Labour Inspection so that it is verified if there is a legal labour relationship between the PR's and the company for which they carried out the activity. It should be recalled that the British Consulate recently conducted a campaign alerting its citizens of the deceptive offers to work as public relations during the tourist season in Mallorca.
 

A total of 25 complaints were filed last year for infringing the Advertising Ordinance. Meanwhile, this year, just the last week, 22 fines were filed, as the Local Police controls have increased. In addition, compared to the 2017 season, the schedule has been reduced in common areas, and the Calvià Town Hall has opted to eliminate some distribution points in Magaluf, Santa Ponça and Peguera.

For this summer season, it has been delimited that dynamic advertising of discotheques, dance clubs, night clubs and similar can only be carried out in four areas of Magaluf located in three crossings and a roundabout, in addition to one point in Santa Ponça and another in Peguera. For these establishments, PR's have to wear the regulatory navy blue vest and work maximum from 6 p.m. to 4 a.m. The rest of the establishments can carry out dynamic promotion in front of their facades. The schedule to carry out this type of advertising diffusion is more restricted, from 8 p.m. to 2 a.m. In these cases, PR's have to wear a light blue vest that the Town Hall supplies after granting the licence.

Dynamic advertising in the Balearic Islands is regulated by Law 5/1997, and establishes that the consistories have the competence to regulate the granting of licences, as well as establishing the maximum number of PR's allowed, delimiting the areas where it can be carried out and the schedule.
